THIS IS THE LOOK OF A MAYOR WHO IS SERIOUS AND HAS HAD ENOUGH. MAYOR CHARMAINE TAVARES - FLANKED BY PLANNING DIRECTOR JEFF HUNT AND DEPUTY CORPORATION COUNSEL JANE LOVELL - MADE IT CLEAR AS SHE COULD: TRANSIENT VACATION RENTALS NOT IN COMPLIANCE WITH THE LAW WILL BE CLOSED. PERIOD. AT HER PRESS CONFERENCE TUESDAY - ATTENDED MOSTLY BY PEOPLE WHO WERE NOT MEMBERS OF THE PRESS - MAYOR TAVARES ASKED EACH OF HER PRESENTERS TO CLEARLY STATE THE FACTS.

IT WAS LOVELL'S JOB TO CLARIFY STATEMENTS MADE WHEN A U.S. DISTRICT JUDGE DISMISSED THE LAWSUIT FILED AGAINST THE COUNTY TO STOP THE SHUTDOWN OF ILLEGAL VACATION RENTALS. SHE ALSO ENCOURAGED INTERESTED PARTIES TO RELY ON THE FACTS OF THE JUDGES'S LENGTHY WRITTEN STATEMENT - AND NOT ON WHAT SHE TERMED AS "INTERPRETATIONS" AND ANECDOTES ON THE WEBSITE OF THE MAUI VACATION RENTAL ASSOCIATION.

PLANNING DIRECTOR JEFF HUNT - ON THE HOT SEAT ON THIS TOPIC SINCE HE TOOK OVER THE COUNTY'S TOP PLANNING JOB LAST YEAR, REVIEWED THE HISTORY OF THE ISSUE. HE ALSO RESPONDED TO QUESTIONS, CONFIRMING THAT - AT NO TIME HAS ANY VACATION RENTAL BEEN IMMEDIATELY SHUT DOWN. HE TOLD MAUI TV NEWS THERE HAVE BEEN THREE NOTICES OF VIOLATION WRITTEN TO TVR OWNERS OVER THE LAST YEAR, AND 50 NOTICES OF WARNINGS - ALL OF WHICH HAVE BEEN BASED ON COMPLAINTS MADE BY NEIGHBORS OF OFFENDING TVRS - AND NOT MERELY AT THE COUNTY'S WHIM.

THE MAUI VACATION RENTAL ASSOCIATION HAS UNTIL NEXT FRIDAY, THE 18TH, TO REFILE THEIR LAWSUIT. THEY WILL HOLD IT'S OWN PRESS CONFERENCE NEXT TUESDAY IN FRONT OF THE COUNTY BUILDING TO PRESENT THEIR SIDE. J: THE TRANSIENT VACATION RENTAL SHUTDOWN IDEA FIRST BECAME A SERIOUS ONE JUST ABOUT A YEAR AGO. IT'S A TOPIC THAT HAS REVERBERATED THROUGH LOCAL STREETS AND NEIGHBORHOODS AND ACROSS HEADLINES IN TRAVEL MAGAZINES AROUND THE WORLD.

NOW THERE'S ANOTHER TOPIC THAT IS WORRYING A LOT OF MAUI COUNTY CITIZENS. THE MAUI COUNTY COUNCIL IS CONSIDERING LEGISLATION TO ADDRESS THE TOPIC OF HOME-BASED BUSINESSES.

AS THE LAW READS NOW, PEOPLE OPERATING A BUSINESS FOR PROFIT ARE - TECHNICALLY - BREAKING THE LAW.

GB03: "They certainly are. There are a lot of thje and it certainly needs to be dealt with."

SO WHAT CAN YOU DO ABOUT IT?

GB03: (con't): "Well, with a little bit of luck we're going to make home occupations that do not cause distraction or trouble in the neighborhoods able to apply for a permit and operate legally and hopefully take some traffic off the road. And build families. Maybe allow mom to do some computer work at home while she takes care of the kids and takes care of Grandma too."

TITLE 19 OF THE MAUI COUNTY CODE HAS BEEN ON THE BOOKS FOR A LONG TIME. SO HAS THE IDEA OF MAKING HONEST PEOPLE OUT OF THOSE WHO CHOOSE TO WORK WHERE THEY LIVE.

ONE YEAR AFTER TVR SHUTDOWN BEGAN, HERE COMES A SIMILAR FATE FOR HOME BASED BSUINESSES?

JY: STARTING NEXT WEDNESDAY, HAWAII SUPERFERRY WILL ADD A SECOND RUN BETWEEN MAUI AND O'AHU. ORIGINALLY, A SECOND KAHULUI-HONOLULU ROUTE WAS NOT PLANNED TO BEGIN UNTIL A SECOND FERRY WAS ADDED TO THE FLEET IN ABOUT A YEAR FROM NOW. THE REASONS FOR THE NEW SERVICE VARY - DEPENDING ON WHO YOU ASK.

(vo) A STATEMENT FROM SUPERFERRY CEO, JOHN GARIBALDI, SAYS THE ADDED ROUTE WILL BENEFIT COMMERCIAL CUSTOMERS BY GIVING THEM MORE FLEXIBILITY IN REACHING THEIR MARKETS. A LITTLE LATER IN THE STATEMENT HOWEVER, GARIBALDI ACKNOWLEDGES THAT THE COMPANY NEEDS TWO RUNS PER DAY IN ORDER TO BE SUCCESSFUL. UNTIL ALL SIDES ARE ASSURED OF A SAFE DAILY TRIP BETWEEN HONOLULU AND NAWILIWILI HARBOR ON KAUAI, THAT SECOND DAILY TRIP WILL HAVE TO BE A SECOND RUN TO AND FROM MAUI.

(FF-CG-VO) STARTING WEDNESDAY, THE SECOND SUPERFERRY TRIPS WILL LEAVE MAUI AT 8 P.M., EVERYDAY BUT SATURDAY - ARRIVING IN HONOLULU AROUND 11 P.M. THE CURRENT SCHEDULE WILL REMAIN UNCHANGED, WITH DAILY DEPARTURES FOR HONOLULU LEAVING KAHULUI HARBOR AT 11:15 EACH MORNING.

(on-cam) SUPERFERRY OPPONENTS, ALREADY CONCERNED ABOUT A HIGH-SPEED VESSEL PLYING THE SHALLOW WATERS OF HAWAII DURING WHALE SEASON, NOW SAY THEY'RE EVEN MORE WORRIED. THEY SAY THE COVER OF DARKNESS WILL MAKE IT ALMOST IMPOSSIBLE TO DETECT ANY HUMPBACK WHALES IN THE PATH OF THE ALAKAI, POINTING OUT THAT THE RISK IS HIGHER AFTER DARK BECAUSE HUMPBACK WHALES ARE MORE ACTIVE AT NIGHT THAN THEY ARE DURING THE DAY.

MAUI MAYOR CHARMAINE TAVARES ADDED HER NOTE OF DISPLEASURE TO THE ANNOUNCEMENT THAT CAME LAST FRIDAY. SHE SAYS HER OFFICE WAS NEITHER CONSULTED - NOR EVEN INFORMED - ABOUT THE ADDED SERVICE. SHE ALSO EXPRESSED CONCERN THAT THE TRAFFIC MANAGEMENT PLAN - STILL UNRESOLVED IN MAUI JUDGE JOEL AUGUST'S SECOND CIRCUIT COURT - ONLY CONCERNS ONE DAILY SUPERFERRY VISIT TO MAUI - AND NOT TWO.

J: FOR MONTHS NOW, SUPERFERRY OPPONENTS HAVE SAID THAT THE DAILY PASSENGER SERVICE IS JUST A TEMPORARY DISTRACTION WHILE GOVERNMENT DEALS TO MOVE HUGE MILITARY EQUIPMENT BETWEEN THE ISLANDS IS THE REAL LONG-TERM PLAN FOR THE GIANT CATAMARAN.

(VO) WELL, THIS WEEK, THE TRANSPORT BEGAN. ON MONDAY MORNING, TWO DOZEN PIECES OF HEAVY MACHINERY FROM THE HAWAII ARMY NATIONAL GUARD WERE DELIVERED TO MAUI ON THE ALAKAI. DUMP TRUCKS, EXCAVATORS, BULL DOZERS AND MORE ROLLED OFF THE SUPERFERRY TO MAKE THE TREK TO UPCOUNTRY MAUI TO AID IN THE EFFORT TO RESTORE WATERSHED LANDS AND ROADWAYS SEVERELY DAMAGED BY THE KONA STORMS OF A MONTH AGO.

(ONCAM) ACCORDING TO ONE SOURCE, THE COUNTY AND THE STATE DEPARTMENT OF TRANSPORTATION SAID SIMILAR EQUIPMENT UNDER THEIR CONTROL IS ALREADY BEING USED IN THE CLEANUP, OR IS COMMITTED TO OTHER PROJECTS. THE CLEANUP EFFORT IS EXPECTED TO LAST THROUGH THE END OF JANUARY.

THE CAMPAIGN ALSO OFFERS FREE PORTABLE ASH TRAYS FOR THOSE WHO SMOKE AT THE BEACH.
