(TAKE SURF PKG) A DAY AT THE BEACH. IF YOU KNOW WHAT YOU'RE DOING, IT CAN BE A BLAST. ONELOA IN SOUTH MAUI CAN BE A TRICKY SPOT, HOWEVER - ONE SECOND IT'S LAKE MAUI - A MOMENT LATER, LOOK OUT. TUESDAY - WHILE THE HIGH SURF WARNING FLAGS FLEW - AND MANY STAYED ONSHORE - JUST OVER THE HILL AT THE SAPOT CALLED LITTLE BEACH A ROGUE SET OF WAVES UP TO 15 FEET HIGH TRAPPED TWO MEN IN A RIP CURRENT. ONLY ONE MADE IT TO THE BEACH ALIVE. THE OTHER, 49 YEAR-OLD JACOB PELTA, DROWNED - DESPITE THE EFFORTS OF WATER SAFETY CREWS TO REVIVE HIM WITH C-P-R.

ON MAUI'S NORTH SHORE, WAVES TOPPED 50 FEET ON MONDAY AND EVEN MAUI'S CHIEF SAFETY OFFICER - AND LEGENDARY WATERMAN - ARCHIE KALEPA WAS NO MATCH FOR THE CONDITIONS. KALEPA, SEEN HERE DURING A RECENT INTERVIEW, SUFFERED SEVERE DAMAGE TO HIS LEFT KNEE AFTER A WIPEOUT AT JAWS IN WAVES AS HIGH AS 50 FEET.

IF THERE'S A MORAL TO THE STORY, IT'S THAT NO ONE IS IMMUNE TO THE POWER OF THE OCEAN. SHE IS MASTERPIECE OF NATURE - A WORK OF PURE ELEGANCE THAT DEMANDS CONSTANT ATTENTION - ESPECIALLY WHEN THE SURF'S UP.

(ON-CAM TAG) IN FACT, AS OF WEDNESDAY AFTERNOON THIS WEEK - THE HUGE SWELL TRAINS WERE IN SUCH RAPID SUCCESSION THAT MORE THAN TWO DOZEN HIGH SURF ADVISORIES, WATCHES AND WARNINGS HAD BEEN CONSECUTIVELY ISSUED SINCE JANUARY THIRD.

J: THE "CLEAN" VERSION OF THE OLD SAYING IS THAT "OPINIONS ARE LIKE BELLY BUTTONS - EVERYBODY'S GOT ONE." WELL, NOW IS THE TIME TO SPEAK UP WITH YOURS, OR HOLD YOUR PEACE FOR AT LEAST THE NEXT 20 YEARS.

(TAKE M-I-P PKG) TYPICALLY, COMMUNITY MEETINGS AREN'T VERY EXCITING FROM A VISUAL PERSPECTIVE. BUT THEY'RE NECESSARY. NO, IMPORTANT. NO, REALLY, CRITICAL. ESPECIALLY MEETINGS LIKE THIS ONE. MONDAY NIGHT THE PLANNING COMMITTEE OF THE MAUI COUNTY COUNCIL TREKKED TO THE LAHAINA CIVIC CENTER FOR SHOW...AND LISTEN. NOTABLY ABSENT, HOWEVER WAS WEST MAUI COUNCILMEMBER JOANNE JOHNSON - AND FOR A VERY SAD REASON. JOHNSON'S HUSBAND, JIM, PASSED AWAY MONDAY - AFTER A LENGTHY ILLNESS. COMMITTEE CHAIR SOL KAHOOHALALA ASKED FOR A MOMENT OF SEILNCE FROM THOSE IN ATTANDANCE TO HONOR JOHNSON'S MEMORY - AND LEGACY OF WEST SIDE ACTIVISM, AS WELL AS THE LIFE AND WORK OF ANOTHER WESTSIDER WHO PASSED AWAY THIS WEEK - DAVE CHENOWITH.

THEN THE MEETING CONTINUED. COUNCILORS CAME TO HEAR WHAT WEST SIDE RESIDENTS WANT AS THE COUNCIL PLOTS GROWTH OVER THE NEXT 20 YEARS. THE MAUI ISLAND PLAN DIFFERS - EVEN IF ONLY SLIGHTLY - FROM THE RECOMMENDATION OF THE GENERAL PLAN ADVSIROY COMMITTEE - OR GPAC.

JH01: "It's not significantly different. There are some subtle differences. I think, overall our plan - our recommendation - is very similar to what the GPAC recommended - and the planning commission. Particularly - in West Maui - we didn't recommend as much development because of the constraints: the highway, natural resources, etc."

AS TESTIFIERS MADE THEIR POSITIONS KNOW, THERE WERE BIG ISSUES LIKE THE TOURISM AND LODGING INDUSTRIES. THERE WERE BIG MATTERS LIKE AFFORDABLE HOUSING, TRANSPORTATION AND INFRASTRUCTURE. THEN THERE WERE THE REALLY DOWN-HOME ISSUES - LIKE HOW MUCH SAY SHOULD A COUNTY COUNCIL HAVE COMPARED TO KUPUNA WHO HAVE LIVED SOMEPLACE THEIR WHOLE LIFE - LIKE OLOWALU'S ADELINE KAMAILEOLIHAU KA'AHUI-RODRIGUES.

AR01: "I believe they're telling us how to live. And I believe when you live in that ahupua'a, you decide what you want for that ahupua'a. Don't go into another ahupua'a because those people need that fish - just like you do. But, if they invite you to - that's alright."

THIS YEAR IS NO EXCEPTION. THE FOUNDATION WILL HOLD THEIR ANNUAL JUSTICE MARCH THIS MONDAY MORNING. THEY ASK THAT YOU GATHER AT THE MAUI COMMUNITY COLLEGE PARKING LOT AT WAKEA AND KA'AHUMANU AVENUE AT 10-30. THE MARCH BEGINS AT 11 A.M. AND TRAVELS DOWN KA'AHUMANU AVENUE, ENDING AT HOALOHA PARK NEAR HAWAIIAN CANOE CLUB'S HALE. A FREE MEAL WILL BE SERVED, BUT YOU'RE ASKED TO BRING A DONATION FOR THE MAUI FOOD BANK.

THE AFRICAN AMERICANS ON MAUI ASSOCIATION WILL HOLD TWO CELEBRATIONS MONDAY. AT 8-30, THE GROUP WILL GATHER AT THE STONE OF HOPE MONUMENT IN FRONT OF THE COUNTY BUILDING ON HIGH STREET. THEN THE GROUP WILL MARCH DOWN MAIN STREET TO CAFE MARC AUREL IN WAILUKU. THERE, AWARDS WILL BE PRESENTED TO MAUIANS WHOSE SERVICE IN THE CAUSE OF CIVIL RIGHTS WILL BE HONORED.

IN 1983, 15 YEARS AFTER KING'S DEATH, PRESIDENT RONALD REAGAN SIGNED THE BILL MARKING THE THIRD MONDAY OF JANUARY AS A HOLIDAY HONORING THE SLAIN CIVIL RIGHTS LEADER. IT WAS FIRST OBSERVED IN 1986. J: DESPITE PUBLIC OUTRAGE AT THE SERIOUS INJURY TO TWO MAUI CHILDREN FROM NEW YEARS FIREWORKS - AND LESSER INJURIES TO FIVE OTHER PEOPLE ON MAUI, DON'T LOOK FOR A BAN ON FIREWORKS ANYTIME SOON.

(VO - FILE) DISPLAYS LIKE THIS ONE WILL NOT BE A THING OF THE PAST ANYTIME SOON BECAUSE, ACCORDING TO MAUI MAYOR CHARMAINE TAVARES, IT ISN'T A PRIORITY. THE MAYOR WAS ON O'AHU LAST WEEK AND WHILE THE TOPIC DID COME UP AMONG THE HAWAI'I COUNCIL OF MAYORS, THEY ALL AGREED THAT THERE ARE MUCH MORE URGENT ISSUES TO DEAL WITH. SPECIFICALLY, STOPPING THE STATE FROM RESCINDING TRANSIENT ACCOMMODATION TAX PAYMENTS TO COUNTIES. THE OTHER REASON STOPPING DANGEROUS NEIGHBORHOOD FIREWORKS LIKELY WON'T HAPPEN SOON IS THAT IT BECOMES A FEDERAL CASE BECAUSE SO MANY FIREWORKS ARE SHIPPED OR MAILED TO MAUI THROUGH FEDERALLY REGULATED SHIPPING CARRIERS AND THE U.S. POST OFFICE.

(ON-CAM) DEPENDING ON THE SEVERITY OF THE CHARGE, A FIREWORKS VIOLATION CAN BRING MISDEMEANOR OR FELONY CHARGES. THE COUNTY'S PROSECUTOR HAS NOT ANNOUNCED WHETHER CHARGES HAVE OFFICIALLY BEEN FILED AGAINST THE PARENTS OF THE YOUNG SIBLINGS HURT WHEN A PICKUP BED THEY WERE PLAYING IN ERUPTED IN FLAMES SHORTLY AFTER MIDNIGHT ON NEW YEARS’ DAY.

J: ONE HAIKU MAN IS SINGLE-HANDEDLY TRYING TO HELP A SEGMENT OF THE COMMUNITY SERIOUSLY AFFECTED BY THE SEMI-ANNUAL EXPLOSIONS AND FLASHES: PETS. RON BASS OF HAIKU SAYS HE IS STARTING A GROUP TO HELP PEOPLE WHOSE PETS GET SPOOKED AND RUN OFF EVERY NEW YEAR'S AND FOURTH OF JULY. HIS DOG, SANDY, RAN AWAY THIS YEAR. J: ONE OF MAJOR FOCUSES ON MAUI TV NEWS IN 2010 WILL BE ON RENEWABLE ENERGY. IN A RECENT MEETING WITH MAUI ENERGY CHIEF VICTOR REYES, WE WERE SHOWN THE AGGRESSIVE PLAN THAT WILL HOPEFULLY PUT MAUI ON PACE TO BE 95 PERCENT ENERGY SELF-SUFFICIENT BY 2020 - EVEN THOUGH THE STATE MANDATE IS TO BE JUST 50 PERCENT SELF-SUFFICIENT BY 2030. MORE ON THAT PLAN AS THE NEW YEAR PROGRESSES.

HOWEVER, IT WAS A LITTLE SHOCKING TO LEARN THAT - WITH THE STATE'S ENCOURAGEMENT THAT HOMES AND BUSINESSES BECOME LESS RELIANT ON FOSSIL FUELS - THIS WEEK THE STATE BEGAN ACCEPTING VARIANCES FROM HOMEOWNERS WHO WISH TO BE EXEMPT FROM THE REQUIREMENT THAT SOLAR WATER HEATING BE INSTALLED ON ALL NEW RESIDENCES. THERE ARE THREE REASONS THE STATE MIGHT ACCEPT A REQUEST TO EXEMPT FROM THE SOLAR HEATING LAW

(FF/CG/VO) IT MAY BE IMPRACTICAL DEPENDING ON THE LOCATION OF THE NEW RESIDENCE - OR WHERE AN ALTERNATIVE WATER HEATING METHOD MIGHT BE MORE COST-EFFECTIVE. TWO, A SUBSTITUTE ENERGY SOURCE MAY BE IN THE PLANS FOR THE NEW HOME - LIKE SOLAR THERMAL, PHOTOVOLTAIC OR WIND, AND, THREE, IF A NEW HOME WILL EMPLOY THE SO-CALLED "TANKLESS" WATER HEATER APPROVED BY UNDERWRITERS’ LABORATORY, IT MAY QUALIFY FOR A VARIANCE.

THE PGA'S FIRST MAJOR TOURNAMENT OF THE YEAR - THE S-B-S- CHAMPIONSHIP AT KAPALUA DID JUST FINE WITHOUT THE WORLD'S NUMBER ONE GOLFER. UP UNTIL THE HOME STRETCH IT LOOKED LIKE RORY SABATINI WAS GOING TO WALK AWAY WITH IT ALL. BUT IN THE END IT WAS GEOFF OGILVY WINNING HIS SECOND TOURNAMENT AT THE KAPALUA PLANTATION COURSE WITH A SIX-UNDER 67 ON SUNDAY FOR A FINAL TOTAL OF 22 UNDER FOR THE TOURNAMENT. FOR ALL THAT SWEAT, AND TOIL, OGILVY POCKETED A COOL ONE-POINT-ONE-TWO MILLION DOLLARS. NOT A BAD PAYOFF FOR WHAT MARK TWAIN CALLED "A GOOD WALK, SPOILED."

MAUI NATIVE SON JON SHIROTA IS BACK HOME FOR THE ONLY MAUI PERFORMANCES OF HIS HIGHLY-ACCLAIMED PLAY "VOICES FROM OKINAWA." IT'S A STORY OF CULTURE CLASHES - MIXED WITH COMEDY AND PIERCING DRAMA.
