J: MEANWHILE ACROSS MAUI, THE FUTURE OF KAHULUI HARBOR WAS THE TOPIC OF A PUBLIC MEETING THIS WEEK AND MOST OF THE PUBLIC THERE DIDN'T LIKE THE PLAN.

(Turn to cam) IT'S THE STIFFEST PENALTY EVER FROM AN INCIDENT INVOLVING CORAL REEF DAMAGE. BUT IS IT TOO STIFF? MAUI TV NEWS REPORTER JEFF KING IS FOLLOWING THE STORY.

(take Maui Dive Pkg) ON A SEPTEMBER MORNING IN 2006, THE KAI ANELA WAS THE ONLY SNORKEL BOAT AT MOLOKINI WHEN THINGS WENT VERY WRONG. AN EMERGENCY CALL CAME FROM A FISHING BOAT AND BLUE WATER RAFTING'S CLOUD NINE WAS WAS ONLY YARDS AWAY - BUT COMPLETELY OUT OF SIGHT, ALONG THE BACKSIDE OF THE CRATER.

TG01: ".<< I came around the corner, a boat had said they saw a boat at Molokini. I wasn't sure...at first thought it was a sail boat, but Then I saw it was a Maui Dive Shop boat."

IN THE MOMENTS BEFORE GRUPENHOFF GOT THE DISTRESS CALL AND COLLECTED HIS PASSENGERS, THEN SPED AROUND THE CORNER, HE HAD ONE MISSION.

tg02: ".Save the people. There was no saving the boat. There was obnly a very small part of it sticking out of the water when I got there."

FORTUNATELY FOR THE KAI ANELA, GRUPENHOFF ONLY HAD A FEW PASSENGERS, SO THEY WERE ABLE TO BRING EVERYONE ON BOARD AND HELP TRANSPORT THEM BACK TO SHORE. IN ALL THE INCIDENT THAT DAY HAPPENED AND WAS OVER IN A MATTER OF MINUTES.

FOR THAT, THERE WAS NO REWARD FOR BLUE WATER RAFTING OR FOR GRUPENHOFF, AND THAT'S THE WAY HE WANTS IT.

TG03: "mANY MAHALOS. iT'S JUST THE LAW OF THE SEA. iF THAT HAPPENED TO ME, i'D JUST WANT SOMEONE TO DO WHAT i DID."

NOW, FIFTEEN MONTHS LATER, THE BOARD OF LAND AND NATURAL RESOURCES FINAL REPORT IS OUT. MAUI DIVE SHOP MUST PAY 550 THOUSAND DOLLARS FOR DAMAGE TO 2,000 SQUARE FEET OF CORAL REEF - DAMAGE THE BLNR SAYS WILL TAKE UP TO 80 YEARS TO REPAIR ITSELF. THEY'LL ALSO LOSE THEIR MOLOKINI PRIVILEGES - FOR HOW LONG - THEY WON'T SAY UNTIL NEXT MONTH. AND BECAUSE THE FINAL RULING HAS NOT BEEN MADE, MAUI DIVE SHOP GENERAL MANAGER JEFF STRAHAN SAYS LEGAL COUNSEL HAS ADVISED HIM NOT TO COMMENT ON THE CASE. BUT GRUPENHOFF DID COMMENT.

TG04: "I think it's very stiff. I'd like to see that money go back into Molokini if they're that concerned about it."

WHEN WE MENTIONED THAT HUNDREDS OF CORAL HEADS HAD BEEN DAMAGED WHEN THE KAI ANELA SANK, GRUPENHOFF ACKNOLWEDGED THE TRAGEDY, BUT HE ALSO ACKNOWLEDGED THE WORK MAUI DIVE SHOP HAS DONE TO REPAIR DAMAGE CAUSED BY OTHERS.

TG05: "I don't know how much - how many coral heads have been saved by the repair work they've done, but I would hope that's taken into account."

FOR NOW, IT'S BUSINESS AS USUAL FOR THE KAI ANELA - ONE OF 40 BOATS PERMITTED TO MOOR AT MOLOKINI. IN A FEW WEEKS, THAT MAY CHANGE DRASTICALLY, AND - INSTEAD OF SETTING OFF FOR ANOTHER MEMORABLE ADVENTURE, IT COULD SPEND A LOT MORE TIME PARKED BEHIND THE BUILDING. ANOTHER OF MAUI'S MAJOR ATTRACTIONS MADE HEADLINES THIS WEEK WHEN SNOW AND ICE CAME TO HALEAKALA. SUNRISE TUESDAY BROUGHT THESE UNUSUAL IMAGES TO THE TROPICS. THE SUMMIT WAS CLOSED ALL DAY TUESDAY AND WEDNESDAY AND WAS OPEN ONLY ON A LIMITED BASIS TODAY. MEANWHILE ON THE BIG ISLAND, THIS TIME LAPSE MOVIE SHOWS THE MOONLIT PEAK GETTING SOME SNOW OVER NIGHT, AND EVEN MORE DURING THE DAY.

ON MAUI, THE IMAGES WERE BEAUTIFUL AND WERE FLYING ALL OVER THE INTERNET. BY LAST NIGHT, FROM A DISTANCE, THE IMAGE WAS STILL BREAKTAKING...ESPECIALLY FROM A WARM DISTANCE. THE SAME WEATHER SYSTEM BROUGH MORE THAN 10 INCHES OF RAIN TO EAST MAUI AND MORE THAN 8 INCHES TO PUU KUKUI. AND THE WEATHER CAUSED A POSTPONEMENT OF THE PLAN TO CLOSE MOLOKINI CRATER YESTERDAY TO BLOW UP OLD WORLD WAR TWO ORDNANCE DISCOVERED LAST YEAR. THAT DETONATION - WEATHER PERMITTING - IS SET FOR NEXT FRIDAY, FEBRUARY SEVENTH.

JY: ANOTHER BIG NEWS STORY ON MAUI THIS WEEK ALSO INVOLVES THE OCEAN - OR MORE SPECIFICALLY, THE MANAGEMENT OF SPACE ALONG THE OCEAN AT KAHULUI HARBOR. STATE HARBOR OFFICIALS WERE ON MAUI LAST WEEK TO GATHER PUBLIC INPUT ON THE PROPOSED KAHULUI HARBOR 2030 MASTER PLAN. MAUI TV NEWS WAS THERE.

(Take Kahului Harbor Plan Pkg) IT WAS A SOMBER MOOD - ALMOST DRAMATIC - WHEN STATE HARBOR OFFICIALS CAME TO MAUI LAST WEDNESDAY TO TAKE PUBLIC INPUT ON THE KAHULUI HARBOR 2030 MASTER PLAN. A CROWD OF ABOUT 100 PACKED THE CAMERON CENTER TO LET OFFICIALS KNOW THEIR FEELINGS ON EXPANDING THE HARBOR ACORSS THE NEXT QUARTER-CENTURY.

OFFICIALS FROM THE STATE DEPARTMENT OF TRANSPORTATION CAME TO LISTEN - AND THEY DID - INTENTLY, AS SPEAKER AFTER SPEAKER DETAILED WHY THE HARBOR SHOULD NOT EXPAND. MANY OF THE TESTIFIERS WERE SURFERS AND RECREATIONAL USERS OF KAHULUI HARBOR WHO DETAILED HOW FAVORITE SURF SPOTS WOULD BE DESTROYED BY THE EXPANSION.

SOME BROUGHT PROTEST SIGNS - BUT THEY WOUND UP ALONG THE WALLS INSIDE AND OUTSIDE THE CROWDED AUDITORIUM.

WHILE FEW EXPRESSED SUPPORT FOR EXPANSION OF THE COUNTY'S BUSIEST CENTER FOR COMMERCE, SOME DID SAY THAT IT WAS TIME FOR MAUI TO GROW - AND THAT MEAN SURFERS, PADDLERS AND FISHERMEN WHO HAVE TO GO ELSEWHERE FOR FUN. NOTICABLY ABSENT - ON PURPOSE - WAS TESTIMONY ABOUT THE HAWAII SUPERFERRY. OFFICIALS MADE IT CLEAR FROM THE BEGINNING THAT THAT WOULD BE A TOPIC FOR ANOTHER HEARING ON ANOTHER DAY. THIS NIGHT WAS MOSTLY ABOUT EXPANDING THE WEST BREAKWATER TO ACCOMODATE CRUISE SHIPS - AT LEAST THAT'S WHAT IT WOUND UP BEING MOSTLY DISCUSSED BY THE STEADY STREAM OF INFORMED TESTIFIERS.

SINCE ONLY ONE PERSON SPOKE AT A TIME, THAT MEANT AN ENTIRE ROOM LISTENED - AND SOMETIMES GRUMBLED - AS MAUI'S INEVITABLE GROWTH WAS BLAMED FOR THE NEED TO EASE THE BURDEN OF AN ALREADY OVERCROWDED HARBOR.

VOLUNTEERS NOT ONLY COLLECTED WORN OUT TVS, COMPUTERS AND CELL PHONES - BUT ALSO CASH - AS PARTICIPANTS WERE ENCOURAGED TO DONATE TEN DOLLARS FOR EACH COMPUTER SYSTEM DROPPED OFF.

EVENT FOUNDER RON RICCIO SAYS THE NUMBERS ARE EXPECTED TO SEE A SLIGHT DECLINE AFTER THE RECORD TONNAGE OF LAST YEAR - BUT SAYS THERE WILL ALWAYS BE A NEED.

(on-cam) IT'S THE SECOND WEEK OF COMPETITION IN MAUI INTERSCHOLASTIC LEAGUE PADDLING AND IT'S PROVING TO BE A WIDE OPEN RACE. FOR ONE THING, BALDWIN'S VARSITY WOMEN HAVE NEVER WON A RACE BEFORE. THIS YEAR THEY'RE TWO AND OH. NOT ONLY THAT, BUT THEY'RE THE ONLY UNBEATEN CREW ON THE WATER.

(VO) SATURDAY WAS M-I-L REGATTA NUMBER TWO - AND THE DAY COULD NOT HAVE BEEN MORE BEAUTIFUL. AND THE END OF THE BOYS VARSITY RACE NUMBER ONE COULD NOT HAVE BEEN MORE EXCITING. LAHAINALUNA BARELY EDGED OUT KING KEKAULIKE FOR THE WIN WITH BALDWIN VERY CLOSE BEHIND. THE MEN OF KAMEHAMEHA CAME IN FOURTH.

LANAI'S TEAM CARRIES THEIR CANOE TO THE WATER FOR THE NEXT BIG MATCHUP OF THE DAY: THE VARSITY MIXED CREW HALF-MILE RACE. SEVEN CANOES IN THIS ONE AND THE START WAS EXCITING. NONE OF THESE TEAMS WERE LETTING UP HEADING TOWARD THE QUARTER-MILE TURN. THAT'S THE BALDWIN CREW FIRST AROUND THE FLAG FOR THE SPRINT HOME. THE SPARTANS ON THE BEACH WERE MAKING NOISE FOR THEIR TEAMMATES - IN FACT EVERYONE WAS MAKING NOISE FOR THEIR TEAMS AS THIS ONE WAS ALMOST A PHOTO FINISH. SEABURY HALL TAKES IT BY LESS THAN A HALF-SECOND OVER BALDWIN. LAHAINALUNA WAS ONLY A HALF-CANOE-LENGTH BEHIND THEM.

AND WHEN THERE'S JUST A HALF-SECOND DIFFERENCE, YOUR TEAM DESERVES A VICTORY TUNNEL FOR SECOND PLACE, RIGHT? THAT'S WHAT THE BEARS BELIEVE. AND THE SPARTANS CONGRATULATE THEIR TEAM ON THEIR FIRST PLACE FINISH.
