C. J: THE NUMBERS ARE STAGGERING AND VARY WILDLY DEPENDING ON WHO YOU TALK TO. BUT UNTIL THE NUMBERS - AND THE RULES - CAN BE AGREED UPON, THE MAUI VACATION RENTAL ASSOCIATION HAS FILED A LAWSUIT TO STOP THE COUNTY FROM SHUTTING DOWN ILLEGAL VACATION RENTALS.

(vo) THE LAWSUIT WAS FILED LAST FRIDAY ON BEHALF OF THE MAUI VACATIONAL RENTAL ASSOCIATION. THEIR PRESIDENT GIVES MAUI TV NEWS SOME OF THE BACKGROUND.

(dd01:"During the 90s the demand by visitors for staying in private homes....I think what it's saying is that if you rely on what your overnment tells you then whatever happens is your problem."

DANTES HAD MUCH MORE TO ADD, BUT IN THE INTEREST OF FAIRNESS - SINCE THE COUNTY HAD NOT SEENS THE LAWSUIT AS OF OUR DEADLINE THIS WEEK, THEY DID NOT HAVE THE CHANCE TO RESPOND. WE'LL BRING YOU THEIR REACTION, AND HAVE MORE OF OUR CONVERSATION WITH MVRA PRESIDENT NEXT WEEK.

(on-cam) WHILE THE LAWSUIT DOCUMENTS DO NOT SPECIFY AN AMOUNT TO BE SOUGHT FOR DAMAGES, THE MVRA ESTIMATES THE COUNTY'S LIABILITY COULD APPROACH ONE HUNDRED MILLION DOLLARS.


(Water Cutbacks)(PiP-showers upcountry)

D. JY: WHILE SOME GOOD SOAKING RAINS HAVE MOVED ACROSS EAST MAUI AS WELL AS KAHALAWAI, WATER OFFICIALS SAY IT'S NOT ENOUGH. SO, VOLUNTARY 10 PERCENT CUTBACKS IN CENTRAL AND SOUTH MAUI MAY BECOME MANDATORY.

(VO) THE VOLUNTARY CUTBACKS AREN'T WORKING. SO FAR WATER USE HAS ONLY DROPPED BY ABOUT 5 PER CENT. RECENT RAINS ACROSS MAUI MAY BE GIVING SOME PEOPLE THE FALSE SENSE THAT THE DROUGHT IS OVER.

(sot) Jeff Eng, Dir, Maui Co. br of Water Supply JE01: "The recent rainfall that we've seen will help in that people irrigate less. That's basically it. What we need is a long-term solution and that's why we're looking toward conservation.

(VO) IF CONSERVATION DOES NOT SUCCEED VOLUNTARILY, ENG SAYS A LAW MAY BE NEEDED SIMILAR TO THOSE IN MAINLAND COMMUNITIES THAT WOULD ALLOW ENFORCEMENT OFFICERS TO RESPOND TO WATER WASTERS AND GO AS FAR AS REMOVING WATER METERS. IN THE MEANTIME, ENG IS WORKING TO IMPROVE THE EFFICIENCY OF ONE OF THE BIGGEST WATER WASTERS IN THE COUNTY...THE COUNTY ITSELF. ENG PRAISED ONE COMMUNITY FOR PROVING THAT CONSERVATION IS POSSIBLE.

JE03: "For instance Upcountry. We requested a 10 percent mandatory cutback back in June and they gave us 20 percent. People are doing the right thing up there.

(VO) THERE ARE THINGS EVERYONE CAN DO TO HELP REDUCE WATER CONSUMPTION. VERY SIMPLE THINGS.

(SOT) Jacky Takakura, Administrative Officer, Bd of Water Supply JT01: "If everybody turned off the water in the house when you didn't need it - for example when you're brushing your teeth or shaving, or when you're in the shower soaping up, you don't need to have the water running. You can turn it off. And look around the house. If you see a really green spot in the lawn there's probably a leak in your sprinklers and you need to look at getting it fixed. Then, again, but cutting down the watering of the yard, you can cut it down by one day a week your plants won't die - or even two days, And that will save a lot of water."

(vo) MEANWHILE, WITH SUMMER NOW PAST, UPCOUNTRY RESERVOIRS ARE BEING REPLENISHED, AND THE WATER DEPARTMENT IS BREATHING AT LEAST A SMALL SIGH OF RELIEF.

JT02: "Right now we're cautiously optimistic. The reservoirs are filling. We've had some rain. But we haven't called off the mandatory 10 percent cutback yet because at this time of year it still can get dry. So we're going to wait another month and see how things are. But it is stabilizing."

(ON CAM) AT THE BOARD OF WATER SUPPLY'S NEXT MEETING ON OCTOBER 25TH, THEY WILL SEE HOW WELL CENTRAL AND SOUTH MAUI ARE DOING TOWARD THE VOLUNTARY 10 PER CENT REDUCTION IN WATER CONSUMPTION. IF IT'S NOT GOOD ENOUGH, THE BOARD WILL MAKE THEIR RECOMMENDATION AND THEN THE MAYOR OR THE COUNTY COUNCIL WOULD BE RESPONSIBLE FOR TAKING ACTION.

H. JY: BIIOLOGISTS ARE ASKING YOU AND ME TO BE ON THE LOOKOUT FOR ENDANGERED SEABIRDS WHO WILL LEAVE THEIR NESTS OVER THE NEXT SEVERAL WEEKS TO FLY TO THEIR OCEAN FEEDING GROUNDS FOR THE FIRST TIME IN THEIR LIVES.

(vo) THE 'UA'U, OR HAWAIIAN PETREL, IS ENDANGERED. THE 'UA'U KANI - ALSO KNOWN AS THE WEDGETAIL SHEARWATER, IS NOT ON THE ENDANGERED LIST. FLEDGELINGS ARE QUITE LARGE, WITH WINGSPANS OF MORE THAN THREE FEET, SO THEY MAY BE CONFUSED FOR ADULTS. THEY LEAVE THEIR NESTS AT NIGHT ARE BELIEVED TO USE THE STARTS TO NAVIGATE. THEY ARE OFTEN CONFUSED BY STREETLIGHTS, DECORATIVE LIGHTS - EVEN HEADLIGHTS. AFTER FLYING IN CIRCLES, THEY TIRE AND EVENTUALLY LAND...OFTEN DISORIENTED AND CERTAINLY SCARED.

(on-cam) IF YOU FIND A STRANDED BIRD, HERE'S WHAT THE EXPERTS SAY TO DO.

(FF-VO-CG) FIRST, PROTECT THE BIRD FROM HAZARDS SUCH AS CATS, DOGS AND CARS. AND PROTECT YOURSELF FROM IT. THESE BIRDS ARE LARGE AND THEY CAN BITE. PUT THE BIRD IN A COVERED, WELL-VENTILATED COOL PLACE - LIKE A CARDBOARD BOX WITH HOLES IN IT. VERY IMPORTANT: DO NOT GIVE THE BIRD FOOD OR WATER.

SECOND, CALL THE DIVISION OF FORESTRY AND WILDLIFE AT 984-8100 OR HALEAKALA NATIONAL PARK AT 264-5317 DURING BUSINESS HOURS TO REPORT YOUR FIND. IF IT'S AFTER HOURS, CALL THE MAUI POLICE NON-EMERGENCY LINE AT 244-64-HUNDRED. BE SURE TO LEAVE YOUR NAME, PHONE NUMBER, AND WHEN AND WHERE YOU FOUND THE BIRD.

FINALLY, DON'T RELEASE THE BIRD YOURSELF. TRAINED WILDLIFE EXPERTS WILL INSPECT THE BABY FOR ANY INJURIES AND THEN RELEASE IT WHERE IT WILL BE SAFE.

BOTH BREEDS FACE SEVERE DANGERS DUE TO HUMAN ENCROACHMENT INTO THEIR NATIVE BREEDING AREAS. THE PHILLIES WON 13 OF THEIR LAST 17 GAMES LAST MONTH...AND THE METS LOST A HEARTBREAKER TO THE FLORIDA MARLINS ON THE LAST DAY OF THE MAJOR LEAGUE BASEBALL SEASON TO MAKE THE MAUI BOYíS DREAMS COME TRUE.

(FF-VO-CG) VICTORINO WRAPS UP THE REGULAR SEASON WITH AN OVERALL BATTING AVERAGE OF 281. HE HIT A DOZEN HOMERS THIS YEAR AND 46 R-B-Is. HE ACCOUNTED FOR 78 RUNS...HIT 23 DOUBLES AND THREE TRIPLES. (vo) GROSSMAN TOOK AN EARLY LEAD IN THE GIRLS RACE IN THE SEABURY HALL INVITATIONAL AND NEVER LOOKED BACK. SHE WON ON THIS COURSE TWICE LAST YEAR AND WON IT EASILY THIS TIME WITH A TIME OF 19 MINUTES AND 24 SECONDS...A FULL 10 SECONDS FASTER THAN SECOND PLACE FINISHER JENNA WONG FROM O'AHU'S IOLANI HIGH SCHOOL.

FOR THE BOYS, IT WAS ALSO A THREE-PEAT FOR MAUI AS LAHAINALUNA'S DUSTIN SOLDWISCH SPRINTED TO THE FRONT OF THE PACK IN TH BOYS EVENT. KEEPING PACE THE ENTIRE WAY WAS FELLOW LUNA DANNY WATSON AND THE PAIR FINISHED ONE-TWO IN THE EVENT. IT WAS THE THIRD WIN THIS YEAR FOR SOLDWISCH AND HIS PERSONAL BEST WITH A TIME OF 17 MINUTES AND 52 SECONDS.

(FF-VO-CG) IN THE END IT WAS THE HOME TOWN TEAM WINNING IT AS SEABURY HALLS BOYS WON THE SEABURY HALL INVITATIONAL CROSS COUNTRY MEET. THE LUNAS TOOK SECOND AND MAUI HIGH WAS THIRD. FOR THE GIRLS, KAMEHAMEHA O'AHU CLAIMED THE TOP SPOT. O'AHU'S IOLANI WAS SECOND AND SEABURY HALL TOOK THIRD.
