THAT CHALLENGE WILL FACE EVERYONE WHO WAKES UP AN ELECTED OFFICIAL NEXT WEDNESDAY - AND THEY'LL WAKE UP TO ECONOMIC REPORTS THAT CONTINUE TO LOOK DOWN. WAY DOWN.

IN PUBLISHED REPORTS IN THE MAUI NEWS THIS WEEK, MAUI LAND AND PINEAPPLE CEO DAVID COLE EXPRESSED HIS DISMAY. HIS COMPANY WAS COUNTING ON THE MAJOR SHOT IN THE ARM THAT WOULD COME FROM THE MASSIVE RENOVATION OF THEIR HIGH-END RESORT LOCATIONS IN KA'ANAPALI. THE COLLAPSE OF THEIR MAJOR FINANCING PARTNERS, LEHMAN BROTHERS, MEANS THEY'LL HAVE TO SCRAMBLE TO COMPLETE THOSE PROJECTS. AS THE GIANT COMPANY TRANSITIONS TOWARD MORE LAND THAN PINEAPPLE, COMPANY LOSSES ARE SOARING. FROM DECEMBER OF 2005 TO JUNE OF 2008, MAUI LAND AND PINEAPPLE'S LONG-TERM DEBT HAS INCREASED TEN-FOLD FROM 10.3 MILLION DOLLARS IN '05 TO 103.5 MILLION DOLLARS FOUR MONTHS AGO.

H: RESORT PROJECTS STILL INCOMPLETE MAY NOT BE THE COUNTY'S BIGGEST PROBLEM - ESPECIALLY CONSIDERING THE FACT THAT THE NUMBER OF PEOPLE STAYING IN THOSE RESORTS IS DROPPING LIKE A ROCK.

VISITS TO MAUI COUNTY DROPPED NEARLY 30 PERCENT IN SEPTEMBER - COMPARED TO SEPTEMBER, 2007. THE VISITOR COUNT OF LESS THAN 143 THOUSAND HASN'T BEEN THAT LOW SINCE THE MONTHS FOLLOWING THE TERRORIST ATTACKS OF NINE-ELEVEN. PRIOR TO THAT, YOU HAVE TO GO BACK TO THE FIRST GULF WAR TO SEE THOSE KINDS OF LOW ARRIVAL STATISTICS.

AND THE AMOUNT VISITORS SPEND WHILE VISITING ALSO TOO A DIVE LAST MONTH. TOTAL VISITOR SPENDING OF JUST MORE THAN 187 MILLION DOLLARS WAS DOWN MORE THAN 23 PERCENT FROM THE SAME PERIOD LAST YEAR.

OVERALL, MAUI COUNTY'S NUMBERS WERE THE WILDEST IN THE STATE. THE HIGHEST PER-PERSON PER-DAY SPENDING WAS ON THE ISLAND OF LANA'I - AT 349 DOLLARS. ON THE OTHER HAND, MOLOKA'I SAW THE BIGGEST DROP IN VISITOR SPENDING. THE TAKE ON THE FRIENDLY ISLE OF JUST 1-POUNT-NINE MILLION WAS A 31 PERCENT DROP FROM THE PREVIOUS SEPTEMBER.

STATEWIDE, THE OVERALL VISITOR COUNT DROPPED 19 AND A HALF PERCENT.

(ON-CAM) OVERALL, VISITS TO HAWAII HAVE DECLINED A LITTLE LESS THAN 10 PERCENT FOR THE FIRST THREE QUARTERS OF 2008 COMPARED TO LAST YEAR - BUT THE DECLINES HAVE BEEN MORE DRAMATIC SINCE THE SHUTDOWN OF ALOHA AIRLINES IN APRIL - AND EVEN MORE SEVERE WHEN FINANCIAL MARKETS BEGAN TO CRUMBLE IN AUGUST. WHILE LONGTIMERS KNOW THAT SEPTEMBER IS USUALLY A SLOW MONTH ANYWAY, IT NEEDS TO BE POINTED OUT THAT THESE NUMBERS ARE COMPARING THIS SEPTEMBER WITH THE LAST ONE.

J: DIRECTLY AFFECTED BY THE DROP IN VISITORS ARE THE BUSINESS THAT CATER TO THEM THE MOST. ON MONDAY BLUE HAWAIIAN HELICOPTERS ANNOUNCED PLANS TO LAY OFF 20 EMPLOYEES FROM ITS OPERATIONS ON MAUI AND THE BIG ISLAND.

IN ANOTHER SAD SIGN OF THE TIMES, EARLIER THIS MONTH, MAUI DIVERS JEWELRY STORES CUT ELEVEN WORKERS FROM THEIR STAFF.

AND ANOTHER ANNOUNCEMENT THIS WEEK DOESN'T MAKE THE PICTURE ANY BRIGHTER, EITHER. AND IT ALSO WON'T BE BRINGING A LOT OF PEOPLE BACK AND FORTH FROM THE BIG ISLAND EITHER.

(VO) HAWAII SUPERFERRY ANNOUNCED ON TUESDAY THAT THEIR SECOND SUPERFERRY - WHICH IS ALMOST COMPLETED - WILL NOT COME TO HAWAII TO BEGIN SERVICE BETWEEN O'AHU AND KAWAIHAE ON THE BIG ISLAND IN FEBRUARY, 2009, AS ORIGINALLY PLANNED. SUPERFERRY CHIEF EXECUTIVE OFFICER TOM LEHMAN ANNOUNCED ON TUESDAY THAT THEY WILL POSTPONE THE INTRODUCTION OF THE SECOND VESSEL - AND WITH IT SERVICE TO THE BIG ISLAND, FOR AS MUCH AS A YEAR - OR AT LEAST UNTIL THINGS START TO LOOK BETTER. IN HIS STATEMENT, LEHMAN SAID POSTPONING DELIVERY OF THE SHIP TO HAWAII WILL DEFER MORE THAN 10 MILLION DOLLARS IN STARTUP COSTS. HE SAID THAT WILL HELP THEM STAY IN BUSINESS.

(ON-CAM) HE ALSO ADDED THAT THE SHIP - WHOSE NAME IS STILL A SECRET - IS STILL SCHEDULED FOR COMPLETION OF SEA TRIALS BY THE END OF FEBRUARY, 2009, AND MAY BE DEPLOYED ELSEWHERE IN THE WORLD UNTIL THINGS LOOK MORE FINANCIALLY VIABLE HERE AT HOME.

H: WHEN THE VISITOR SLOWDOWN REALLY BEGAN TO HIT LAST MONTH, MAUI VISITORS BUREAU EXECUTIVE DIRECTOR TERRYL VENCL SUGGESTED THAT BUSINESSES - AND GOVERNMENT - TAKE ADVANTAGE OF THE DOWN TIME TO SPRUCE UP, AND GEAR UP FOR WHEN THE VISITORS RETURN, BECAUSE THEY ALWAYS DO. THIS WEEK, THE PLACE WHERE MOST OF THOSE VISITS BEGIN - AND END – THE KAHULUI AIRPORT - UNVEILED A SHINY NEW SYSTEM.

(vo) IT'S CALLED "CUPPS," WHICH STANDS FOR COMMON USE PASSENGER PROCESSING SYSTEM. IT'S A SERIES OF AUTOMATED CHECK-IN AND TICKETING MACHINES. WHILE THE IDEA OF USER-FRIENDLY TICKET PRINTING IS NOT NEW, THE "CUPPS" SYSTEM STANDARDIZES THE PROCESS SO THAT TRAVELERS BECOME FAMILIAR WITH THE SYSTEM BECAUSE THE MACHINES IN NEARLY ALL AIRPORTS WILL EVENTUALLY OPERATE THE SAME WAY.

(on-cam) THE "CUPPS" STANDARD IS EXPECTED TO BECOME MANDATORY AT MAJOR AIRPORTS WITHIN THE NEXT THREE TO FOUR YEARS, REPLACING THE "CUTE" STANDARD. "CUTE" HAS BEEN THE EXPERIMENTAL SELF-TICKETING SYSTEMS OPERATING AT MANY INTERNATIONAL AIRPORTS. CUTE, BY THE WAY, IS THE ACRONYM FOR "COMMON USE TERMINAL EQUIPMENT."

J: AND AT THAT SAME MEETING, THE MAUI COUNTY COUNCIL WAS URGED TO TAKE ACTION TO HELP PROTECT ONE OF OUR MOST PRECIOUS RESOURCES. DETAILS WHEN MAUI TV NEWS CONTINUES.

J: HER RESPONSE: "SELF-SERVING, SPITEFUL, DISTURBING AND INTRUSIVE." HIS REASON: (PAUSE) HE HASN'T GIVEN ONE.

(VO) THE "HE" IN THIS CASE IS WAILUKU ATTORNEY JAMES FOSBINDER, WHO HAS REPRESENTED BUSINESSES AND LANDOWNERS IN LAWSUITS AGAINST MAUI COUNTY IN THE PAST, AS WELL AS REPRESENTING MANY OF MAUI'S BIKE TOUR COMPANIES WHEN THEY WERE BANNED FROM DOWNHILL TOURS FROM THE TOP OF HALEAKALA. THE "HER" IN THIS CASE IS MAUI COUNTY MAYOR CHARMAINE TAVARES, APPROACHING THE MIDWAY POINT OF HER FIRST TERM IN OFFICE.

(ON-CAM) FORSBINDER SAYS THE MAYOR SHOULD BE RECALLED. ACCORDING TO A PUBLISHED REPORT THIS WEEK IN THE MAUI NEWS, FOSBINDER HAS FILED AN AFFIDAVIT OF REPRESENTATION FOR A GROUP CALLED "RECALL TAVARES." THEY HAVE 30 DAYS TO GATHER 16,000 SIGNATURES FROM REGISTERED VOTERS IN ORDER TO FORCE A SPECIAL RECALL ELECTION. NOW AT THIS POINT, YOU'RE PROBABLY WONDERING "WHY?" WELL, TRUTH IS - FOSBINDER DOESN'T HAVE TO SAY. THE MAUI COUNTY CHARTER SPECIFIES THAT A PETITION DRIVE DOES NOT NEED TO STATE REASONS FOR A RECALL. IT DOES SAY THAT IF THE RECALL TAVARES GROUP DOES NOT GET THE REQUIRED SIGNATURES WITHIN 30 DAYS - THEY GET ANOTHER 20 DAYS TO GATHER THEM.

THE MAUI NEWS ARTICLE SPECULATED THAT THE REASON FOR FOSBINDER'S DRIVE TO DRIVE THE MAYOR FROM OFFICE STEMS FROM HIS UNSUCCESSFUL EFFORTS TO GET THE TAVARES ADMINISTRATION TO BACK DOWN FROM ITS TOUGH STAND ON ENFORCING ZONING LAWS THAT GOVERN TRANSIENT VACATION RENTALS. IN THE PUBLISHED REPORT, FOSBINDER EXPRESSED CONFIDENCE THAT EVERYONE WHO VOTED FOR ALAN ARAKAWA AND DAIN KANE - THE TWO CANDIDATES TAVARES BEAT IN THE LAST MAYORAL ELECTION - WOULD LIKELY SIGN SUCH A PETITION.

FOSBINDER'S GROUP PLANS TO POST VOLUNTEERS AT POLLING PLACES DURING NEXT TUESDAY'S GENERAL ELECTION TO SOLICIT SIGNATURES AS VOTERS LEAVE THE POLLS. BY LAW, THEY HAVE TO STAY AT LEAST 200 FEET BACK – NOT JUST FROM THE POLLS THEMSELVES, FROM THE PARKING AREAS OF ANY POLLING PLACE.

NOW, IF THEY GET THE REQUIRED NUMBER OF SIGNATURES, AND THEY ARE AUTHENTICATED, A PROCESS THAT WILL REQUIRE ADDING THE EXPENSE OF TEMPORARY EXTRA STAFF AT THE COUNTY CLERK'S OFFICE - THEN THE COUNTY CLERK DELIVERS THE PETITION TO THE COUNTY COUNCIL AND TO THE MAYOR. IF SHE DOES NOT RESIGN WITHIN FIVE DAYS, THE COUNTY COUNCIL HAS TO HOLD A SPECIAL ELECTION BETWEEN 60 AND 90 DAYS AFTER THE DOCUMENTS ARE CERTIFIED. FROM THERE, WHO GETS TO VOTE IN THE RECALL ELECTION IS ANOTHER STORY IN ITSELF.

IF YOU'RE CONFUSED BY ALL OF THIS, YOU'RE NOT ALONE. IN THE HISTORY OF MAUI COUNTY - AND IT'S CHARTER, THE RECALL PROCESS HAS NEVER BEEN USED BEFORE.

H: THE MAUI COUNTY COUNCIL IS A BUSY PLACE THESE DAYS. AT TUESDAY'S MEETING OF THE COUNCIL'S POLICY COMMITTEE, TWO IMPORTANT ITEMS WERE ON THE AGENDA.

(VO) THE FIRST DEALT WITH THE BROADCASTER BROADCASTING THE HEARING. AKAKU:MAUI COMMUNITY TELEVISION IS THE SUBJECT OF A PROPOSED STATE RESOLUTION THAT WOULD EMPOWER THE DEPARTMENT OF COMMERCE AND CONSUMER AFFAIRS TO WORK WITH ALL FOUR COUNTIES IN THE STATE TO NEGOTIATE HOW THE SO-CALLED "PEG" FUNDS ARE SPENT.

PEG STANDS FOR PUBLIC, EDUCATIONAL AND GOVERNMENT. AKAKU IS PRIMARILY FUNDED BY A MANDATED PORTION OF THE CABLE BILL YOU AND I PAY EVERY MONTH. IT'S THAT LITTLE LINE THAT SAYS "CABLE FRANCHISE FEE" AND IT GOES TO THE BROADCASTER TO PROVIDE PUBLIC ACCESS TO THE AIRWAVES.

THE MONK SEAL RECENTLY REPLACED THE HUMPBACK WHALE AS THE HAWAII STATE MAMMAL. THEY HAVE BEEN AROUND FOR 13 MILLION YEARS, SCIENTISTS SAY, AND NOW THEY ARE CRITICALLY ENDANGERED AND ON THE VERGE OF EXTINCTION. THE FOCUS OF THE RESOLUTION IS TO PUT COUNTY SUPPORT BEHIND THE STATE AND FEDERAL PROPOSED BILLS, DESIGNED TO REBUILD A HEALTHY POPULATION OF SEALS AND REVERSE THE RAPID DEPLETION OF THIS COMPLETELY UNIQUE TROPICAL SPECIES.

THE COUNTY COUNCILS OF KAUAI AND HAWAI'I ISLAND HAVE ALREADY PASSED SIMILAR RESOLUTIONS AND THE HONOLULU CITY AND COUNTY COUNCIL WILL HEAR A SIMILAR PROPOSAL THIS WEEK.
