THE COUNTY CONTENDS THAT MERRILL LYNCH SOLD THE AUCTION RATE SECURITIES TO THE COUNTY WITH THE UNDERSTANDING THAT THE SECURITIES WERE SAFE, SHORT-TERM, LIQUID INVESTMENTS. BUT - FOR REASONS NOT MADE CLEAR - MAUI COUNTY DOES NOT HAVE ACCESS TO THOSE ASSETS.

MAYOR CHARMAINE TAVARES STATED THAT THE COUNTY WAS TOLD INVESTMENT COULD BE EASILY ACCESSED - JUST LIKE CASH - AND WENT ON TO SAY THAT ASSURANCES BY MERRILL LYNCH AT THE TIME TURNED OUT TO BE FALSE, SO WE ARE SEEKING JUSTICE FOR THE TAXPAYERS OF MAUI. - UNQUOTE.

THE COUNTY HAS HIRED SPECIAL COUNSEL TO HELP RECOVER THE FUNDS, AND THE INVESTMENT FIRM SAYS IT HAS ABANDONED THE PRACTICE OF CARRYING THOSE SO-CALLED AUCTION-RATE SECURITIES."
