(TURN TO CAM) THE FINAL DECISION OF THE STATE WATER COMMISSION PROBABLY WON'T BE THE FINAL, FINAL DECISION ON NA WAI EHA STREAM FLOWS - NOT IF THE ATTORNEYS HAVE THEIR WAY.

(TAKE NA WAI EHA PKG) STILL SMARTING FOR A SURE-TO-BE-CONTESTED DECISION IN THE EAST MAUI STREAMFLOW CASE, HAWAIIAN COMMERCIAL AND SUGAR GENERAL MANAGER GOT AT LEAST A TEMPORARY REPRIEVE FROM POTENTIAL PANIC AFTER THE STATE WATER COMMISSION REMOVED "ONLY" 12 AND A HALF MILLION GALLONS A DAY FROM THE AMOUNT CURRENTLY TAKEN BY HC&S FROM NA WAI EHA - THE FOUR WEATERS OF WEST MAUI.

CB01: "Well, I think we certainly were very releived. Because after what the initial recommendation had been from the hearing officer, we were very concerned. Adoption of that recommendation could, literally, have shut us down."

BENJAMIN EXPLAINED THAT THE TOTAL FLOW OF NA WAI EHA IS ABOUT 34 MILLION GALLONS A DAY.

CB02: "The loss of 34.5 million galls - which was the original recommendation would have essentially meant that almost half the year we would have had no water at our reservoir and no water for irrigation. So the impact would have been devastating had we lost all that water. It's still significant chunch because 12 and a half million gallons a day out of an average of about 30 or so is still significant. And that's an average, so that means that - at times - it's a lot lower than that. So it will still be a big impact but it's significant better than it might have been."

BENJAMIN THINKS THE COMMISSION DECISION WAS FAIR AND BALANCED.

CB03: "I think they recognize the value of the off-stream users. Their role is to balance the on-stream and off-stream benefits of the use of the water in the public interest. And I thibnk that's what did. They restored some water to streams for biological reasons, and they also helped to protect the off-stream uses of the water which are vital to the benefit to the people of Maui."

BENJAMIN SAYS THE DECISION CALLS FOR SOME IMMEDIATE STREAM RESTORATION AND SAYS HIS COMPANY WILL COMPLY - BUT HE IS CONCERNED WHAT MAY HAPPEN IF A LOT OF WORK IS DONE TO UN-DIVERT WATER IF ANY PART OF THE DECISION IS REVERSED ON APPEAL. SO LOOK FOR MORE CROWDED GATHERINGS LIKE THE MAY 26TH MEETING IN PA'IA. AND WHY? BECAUSE THE COMMISSION IS STILL WORKING TO SETTLE STREAM FLOW RESTORATION APPEALS TWO CASES AGO. MEANWHILE, HC&S IS WORKING FULL SPEED AHEAD ON DEVELOPING AT LEAST A PORTION OF THE PLANTATION DEDICATED TO GROWING CROPS FOR BIOFUELS.

J: WATER IS THE MEDIUM - BUT IT'S WHAT'S IN THE WATER AND WHAT SHOULD OR SHOULDN'T STAY THERE THAT'S RAISING TEMPERS AMONG MANY ON MAUI.

(VO) TWO WEEKS AGO THE MAUI COUNTY COUNCIL HEARD TESTIMONY ON TWO BILLS - DESIGNED TO REGULATE THE SO-CALLED AQUARIUM FISH TRADE, AT LEAST ALONG MAUI'S FRAGILE REEFS. WHILE THERE WERE STRONG OPINIONS FROM BOTH SIDES, A MAJOR PLAYER WINDS UP GETTING CAUGHT IN THE MIDDLE - THE MAUI OCEAN CENTER.

(TAKE MOC VO-SOT) MORE TESTIMONY WAS HEARD THIS WEEK ON EACH OF THE TWO MEASURES UNDER CONSIDERATION. THE BILL PROPOSED BY COUNCILMEDMBER MIKE MOLINA COVERS THE HUMANE TREATNMENT OF CAPTURTED ANIMALS - SPECIFICALLY AVOIDING THE FISH OUT OF WATER THREATS AND RTOUGH HANDLING THAT RESULTS IN AN INCREDIBLY HIGH MORTALITY RATE. THE BILL PROPOSED BY COUNCILMEMBER WAYNE NISHIKI SAYS THAT IF REEF FISH COLLECTION IS TO HAPPEN AT ALL IN MAUI WATERS, IT NEEDS TO BE REGULATED AND MONITORED REGULARLY.

STILL - STUCK IN THE MIDDLE IS THE HAWAIIAN AWUARIUM - MAUI OCEAN CENTER GENERAL MANAGER KATE ZOLEZZI GAVE US THE AQUARIUM'S POSITION ON WHICH OF THE TWO MEASURES COULD WORK.

Kate Zolezzi, GM, Maui Ocean Center

KZ01: "Well, they both could but Maui Ocean center has stated publically that in Mister Molina's bill we do have some concerns about the language and unintended consequences. However in Mister Nishiki's bill, we fell like the language and the intent is more clear and we have come out and said we publically support that. We've also suggested some minor amended language for that bill."

REEF ADVOCATES SAY FISH POPULATIONS HAVE DECLINED BY 60 PERCENT OVER THE PAST 20 YEARS. PROFESSIONAL AQUARIUM FISH COLLECTORS SAY THEY ALREADY HAVE STATE RULE TO FOLLOW AND THAT IF THE NUMBERS ARE DROPPING SO SEVERELY, IT MAY BE DUE TO MAN-MADE POLLUTANTS IN RUNOFF.

IN EITHER CASE, NO NEW LANGUAGE WAS ADDED TO EITHER PROPOSAL TO EXEMPT OR PROTECT THE FISH COLLECTION WORK OF THE HAWAIIAN AQUARIUM. SO, STILL THERE ARE TWO VERY OPPOSITE SIDES AND ONE VERY CONCERNED ENTITY STUCK RIGHT IN THE MIDDLE.

(ON-CAM TAG) THE COUNTY COUNCIL TOOK UP THE ISSUE AGAIN THIS WEEK - BUT IT ISN'T CLEAR WHICH OF THE TWO PROPOSALS WILL MOVE FORWARD. IF AN OUTRIGHT BAN PASSES, MAUI WOULD BE THE ONLY COMMUNITY IN THE NATION TO OUTLAW THE COLLECTION OF REEF FISH. THAT COULD POSSIBLY SPELL THE END OF THE MAUI OCEAN CENTER.

(UPCOUNTRY DROUGHT)(PiP-EMPTY RESERVOIR)

J: MEANWHILE, BACK AT THE TOPIC OF WATER ITSELF - UPCOUNTRY IT'S ALMOST GONE AND THE BOARD OF WATER SUPPLY HAD TO DO SOMETHING ABOUT IT.

(FF-CG-VO) THIS IS HOW THE KAHAKAPAO RESERVOIR LOOKED TUESDAY MORNING. ABLE TO HOLD 100 MILLION GALLONS OF WATER, THIS WEEK IT'S DOWN TO BARELY A QUARTER OF THAT. AND THE COMPANION 30 MILLION GALLON WAIKAMOI RESERVOIR IS EMPTY.

(ON-CAM) TO CONTINUE TO MEET DEMAND, THE BOARD OF WATER SUPPLY ISSUED AN URGENT PLEA TO UPCOUNTRY WATER USERS TO USE LESS WATER UNTIL THE RAINS COME. TO MAKE UP FOR THE EMPTY RESERVOIRS, THE WATER DEPARTMENT WILL HAVE TO PUMP WATER UP FROM THE KAMOLE WATER TREATMENT FACILITY IN HALI'IMAILE, THE PI'IHOLO FACILITY IN MAKAWAO AND THE PO'OKELA WELL IN MAKAWAO. CUSTOMERS WILL LIKELY NOTICE A CHANGE IN WATER QUALITY STARTING THIS WEEKEND BECAUSE WATER TREATED AND PUMPED UP FROM DOWNCOUNTRY IS DISINFECTED WITH CHLORINE. IT TASTES A LITTLE FUNNY BUT IT'S SAFE AND FAR EXCEEDS FEDERAL CLEAN WATER STANDARDS. AND, AS LUCK WOULD HAVE IT - WATER USERS ARE USING MORE LATELY. LAST YEAR AN AVERAGE OF 7 AND A HALF MILLION GALLONS PER DAY WAS CONSUMED UPCOUNTRY. OVER THE PAST TWO WEEKS, THAT HAS SWELLED TO A DAILY CONSUMPTION OF MORE THAN NINE MILLION GALLONS.

J: AND IT'S A SWELL OF A DIFFERENT KIND...POLITICAL YARD SIGNS. THE PRIMARY ELECTION IS SEPTEMBER 18TH THIS YEAR, MORE THAN THREE MONTHS FROM NOW. THE GENERAL ELECTION IS NOVEMBER SECOND.

(VO) SO, ISN'T IT A LITTLE EARLY TO BE INUNDATED WITH YARD SIGNS? WELL, YES...AND NO. THE LAST TIME NEIGHBORS GOT FED UP WITH NEIGHBORS PLUGGING THEIR CHOICES FOR OFFICE, A PROPOSED ORDINANCE WAS PUT BEFORE THE MAUI COUNTY COUNCIL. THAT WAS IN 2004. WE ASKED THE COUNTY CLERK'S OFFICE WHAT THE RULES ARE REGARDING HOW SOON POLITICAL SIGNS CAN GO UP.

(FF-CG-VO) WE WERE DIRECTED TO PORE THROUGH THE STATUTES OF MAUI COUNTY AND THAT LED US TO THE ORDINANCES OF THE COUNTY - SPECIFICALLY ORDINANCE 32-11 DEALING WITH THE TIME PERIOD WE HAVE TO OR GET TO SEE THE NAMES OF SOMEONE'S FAVORITE CANDIDATES. THE 2004 PROPOSAL SAYS, IN PART, "provided, that such signs or posters shall be permitted only for a period of seventy-five days preceding a general or special election and for a period of ten days following such election."

SEVENTY FIVE DAYS BEFORE OUR PRIMARY WOULD START ON JULY 5TH. BUT HERE'S THE FINE PRINT. LOOK CLOSELY. THAT PORTION OF SECTION TWO OF ORDINANCE 32-11 HAS BRACKETS AROUND IT, FOLLOWED BY SECTION THREE WHICH STATES, "MATERIAL TO BE REPEALED IS BRACKETED."

IF RIDING A BULL DIDN'T WORK OUT - AS WAS THE CASE FOR THESE COWBOYS, THEN PETTING A BULL IN THE FOUR-H TENT WAS NOT ONLY A LOT EASIER - BUT COOLER, TOO. THE LIVESTOCK SHOW AND AUCTION WAS A MAJOR PART OF THE EVENT - AS WAS THE DISPLAY AND SALE OF UPCOUNTRY PRODUCE, FLOWERS AND SUCCULENTS. AND MAUI COUNTY COUNCILMEMBER GLADYS BAISA AND HER HUSBAND SHERMAN HAD TWO OF THE CHOICEST SEATS IN THE HOUSE AS THEY WERE AMONG THE JUDGES IN THE MAUI CATTLE COMPANY COOKING CONTEST. BUT THERE WAS PLENTY TO EAT AND BROWSE FOR EVERYONE ELSE, TOO.
