COMPANY OFFICIALS SAY IT WILL BE A LITTLE WHILE - WHILE THEY MONITOR OUTPUT TO BE SURE THEY'RE ALLOWING THE RIGHT AMOUNT OF WATER OUT - AND NOT TOO MUCH.

THE RETURN OF FLOWING WATER FOR TARO FARMING AND FOR THE HEALTH OF ANIMALS AND PLANTS THAT INHABIT THE STREAMS HAS BEEN THE SUBJECT OF BATTLE FOR MANY YEARS. APPEALS FROM EARTHJUSTICE AND MAUI TOMORROW ARTE HEADED BACK TO COURT TO INCREASE STREMFLOWS EVEN FURTHER.

(VO) THE STATE SUPREME COURT RULED THAT THE LANA'I NATIVE WAS ACTUALLY A LAHAINA RESIDENT WHEN HE RAN FOR - AND WON - THE LANA'I SEAT ON THE MAUI COUNTY COUNCIL IN 2008. THAT RULING, THOUGH, WAS SOMETHING OF A FORMALITY AND DIDN'T JEOPARDIZE HIS POSITION.

(ON-CAM) SINCE THEN, KAHO'OHALALA HAS DECIDED TO RUN FOR MAYOR. MEANWHILE A HUI OF 17 LANA'I RESIDENTS HAVE FILED A LAWSUIT CLAIMING THAT THE COUNCILMEMBER - AND FORMER CHAIRMAN OF THE KAHO'OLAWE ISLAND RESERVE COMMISSION - SHOULD BE STRIPPED OF HIS SEAT. A NON-JURY TRIAL OPENED MONDAY, DURING WHICH LYNN KAHO'OHALAHALA TESTIFIED THAT HER HUSBAND DOES STAY ON MAUI DURING COUNCIL SESSIONS AND TO CONDUCT BUSINESS. OTHERWISE, HE'S AT HOME ON LANA'I. IF THE PLAINTIFFS PREVAIL, KAHO'OHALAHALA MIGHT LOSE HIS SEAT ON THE MAUI COUNTY COUNCIL - REQUIRING A SPECIAL ELECTION TO REPLACE HIM. THE DECISION, HOWEVER, WOULD NOT AFFECT HIS CANDIDACY FOR MAYOR.

J: AND IT'S NOT AS INTRIGUING AS SOMETHING OUT OF AN IAN FLEMING NOVEL, BUT - NONETHELESS - A MAUI MAN HAS BEEN CONVICTED AS A SPY FOR TRYING TO SELL B-2 STEALTH BOMBER SECRETS TO CHINA.

(FF-CG-VO) NOSHIR GOWADIA WAS FOUND GUILTY ON MONDAY BY A JURY IN FEDERAL COURT IN HONOLULU. GOWADIA, A FORMER ENGINEER FOR THE NORTHROP COMPANY, WAS CONVICTED FOR SELLING MILITARY SECRETS TO CHINA ON THE B-2 STEALTH BOMBER TECHNOLOGY AND FOR GIVING THEM SECRETS ON HOW TO BUILD A CRUISE MISSILE THAT COULD AVOID AIR-TO-AIR DESTRUCTION BY U.S. AND ALLIED FORCES.

THE 66 YEAR-OLD HAIKU RESIDENT COULD FACE LIFE IN PRISON FOR HIS CRIME. PROSECUTORS SAY HE SOLD THE SECRETS TO PAY FOR HIS LAVISH LIFESTYLE AND MAKE MORTGAGE PAYMENTS ON HIS HAIKU MANSION. HE REPORTEDLY RECEIVED 84,000 DOLLARS. GOWADIA WAS CONVICTED ON 14 OF 17 COUNTS - INCLUDING TRYING TO SELL OR GIVE SECRETS TO UNDERCOVER AGENTS IN ISRAEL AND GERMANY. HIS DEFENSE ATTORNEY CONTENDS THAT THE SO-CALLED "SECRETS" WERE NO MORE THAN INFORMATION OTHER PEOPLE COULD FIND ON THE INTERNET. THE JURY, APPARENTLY, DIDN'T AGREE.
